Terms of use

These Terms of Use ("Terms") apply to the website smartapple.co, its language versions and its installable web app (together, the "Site"). Please read them before using the Site.

1. Who runs the Site

The Site is a personal website written and run by a private individual ("I", "me", "my"). It is not run by a company. Smart Apple is the name of my publication.

You can contact me at a direct message on Instagram. More details are in the Legal Notice.

2. Accepting these Terms

By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

These Terms do not affect any rights you have under the law of the country where you live that cannot be excluded by agreement.

3. What the Site is

Smart Apple publishes short, animated explainers about everyday things and technologies. Each story is made of short video loops, pictures and text, with a list of sources for the claims it makes.

The Site is free. It has no public user accounts, no comments, no advertising and nothing for sale. You do not need to register to read it. It is available in English, Japanese, Spanish and Brazilian Portuguese, and music plays when you choose to enter with sound.

4. Using the Site

You may use the Site for your own personal information.

You must not:

• copy, scrape or download content in bulk, by automated means or otherwise, except as allowed in section 5;
• interfere with the Site's security or operation, or try to reach parts of it that are not public (such as the admin area);
• use the Site in a way that breaks the law or infringes anyone's rights;
• present my content as your own, or remove credits, watermarks or Content Credentials from it;
• use the Site or its content to suggest that I endorse you, your products or your views.

I may suspend the Site, or parts of it, for maintenance, security or legal reasons. I do not guarantee that the Site will always be available or free of errors.

5. My content and how you may share it

5.1 Ownership

Unless stated otherwise, the texts, videos, animations, illustrations, graphics, logo, layout and design of the Site ("my content") belong to me or are used under licence. They are protected by copyright, including Romanian Law no. 8/1996 on copyright and related rights.

The Smart Apple name and logo identify my publication. Do not use them in a way that could cause confusion about who you are or who made something.

5.2 What you may do

You may, free of charge:

• share links to any page of the Site, with the share buttons or by copying the address;
• share my Instagram posts with Instagram's own sharing and embedding tools, within Instagram's terms;
• quote short excerpts of my text for commentary, criticism, review, teaching or news reporting, with the credit "Smart Apple (smartapple.co)" and a link to the original page, as copyright law allows;
• use a single still frame or screenshot of a story to illustrate a link to it or a review of it, with the same credit and link;
• subscribe to the RSS feeds (for example smartapple.co/en/feed.xml) in a feed reader for your own reading.

Search engines and AI services may index the Site, show short excerpts with a link to the original page, and use the summaries published for them (smartapple.co/llms.txt and smartapple.co/llms-full.txt), as set out in section 5.4. When they quote or summarise my stories, they should credit Smart Apple and link to the original page.

5.3 What you may not do without my written permission

• download, re-upload or republish my videos or full stories, on any platform;
• edit, translate, re-voice, crop out credits or make derivative works from my content;
• use my content in advertising, sponsored posts or for any commercial purpose.

To ask for permission, write to a direct message on Instagram.

5.4 Search engines, AI systems and text and data mining

The text I publish on the Site may be read, indexed and used by search engines and AI systems, including for training artificial intelligence models. I do not reserve text and data mining rights under Article 4(3) of Directive (EU) 2019/790.

This does not transfer my copyright. Attribution still applies when my work is quoted or summarised, nobody may republish my stories or present them as their own work, and the images, videos and music on the Site remain protected as described in sections 5.1, 5.3 and 5.5.

5.5 Third-party content and trademarks

Some content on the Site belongs to others, such as quoted sources, data, images used under licence, posts from other sites and the music (Moderat, "A New Error"). It stays the property of its owners and these Terms give you no rights to it.

Product names, brand names and trademarks mentioned on the Site belong to their owners and are used only to identify the product or topic being explained. Mentioning them does not mean they endorse the Site or that I endorse them.

6. Posts from other sites

Some stories show posts or videos from services such as Instagram or YouTube. They are not loaded automatically: they load only when you click them. Once loaded, that service may collect data and set its own cookies under its own terms and privacy policy, which govern your use of it. See the Privacy Policy and the Cookies and Local Storage Notice.

7. Accuracy and corrections

I check my content against primary sources (for example official documentation, regulatory documents, standards and peer-reviewed research) and list the sources for each story.

I can still make mistakes, and science and products change. Each story reflects my understanding at the date shown on it.

If you think something is wrong, write to a direct message on Instagram with the subject "Correction", the page address and, if possible, a source. I read every report. When I correct a material error, I update the story and add a dated correction note. I do not silently change the meaning of published claims.

8. Not medical, technical or professional advice

My content is general information for education only.

Health topics (for example medicines, wearables, tests and beauty devices) are explained for general understanding. They are not medical advice, diagnosis or treatment, and do not replace a doctor, pharmacist or other qualified professional. Do not start, stop or change any treatment because of my content. In an emergency, call 112 or your local emergency number.

Products and devices are explained in general terms. Always follow the manufacturer's instructions and safety warnings.

9. Independence from Apple Inc.

Smart Apple is an independent publication. It is not affiliated with, endorsed by, sponsored by or connected to Apple Inc. "Apple" and Apple product names are trademarks of Apple Inc. The name Smart Apple and its apple logo refer to my publication only.

10. Products shown and sponsorship

Products shown in my stories are generic illustrations, unless a story clearly says otherwise. They do not represent a specific brand or model.

My stories are not sponsored and I am not paid to feature products. If I ever publish sponsored or affiliate content, I will label it clearly on the content itself, as the law requires.

11. Use of AI tools and Content Credentials

I use artificial intelligence tools to help create parts of my content, such as animation, illustration and drafting. I review every story and check it against primary sources before it is published, and I remain responsible for it.

My videos carry Content Credentials (C2PA metadata) that record how they were made. Please do not remove or alter this information.

12. Notifications and the installable web app

You can install the Site as a web app and choose to receive push notifications. Notifications are sent only after you turn them on in the Site and allow them in your browser, and you can turn them off at any time. The Privacy Policy explains the related data.

13. Motion effect

On phones and tablets, the collage moves slightly when you tilt your device. This uses the motion sensors inside your browser, only where your browser allows it. The readings stay on your device and are never sent or stored. The Site does not use your camera or microphone.

14. Links to other websites

The Site links to sources and other websites I do not control. I am not responsible for their content, availability or privacy practices, and a link does not mean I endorse them.

15. Liability

I run the Site with reasonable care. Because it is free and for general information, and as far as the law allows:

• I am not liable for decisions you make based on my content;
• I am not liable for loss or damage that was not reasonably foreseeable, or that was caused by events outside my reasonable control;
• I am not liable for the content or practices of third-party sites and services, including Instagram.

Nothing in these Terms limits or excludes liability for death or personal injury caused by fault, for damage caused intentionally or through gross negligence (Article 1355 of the Romanian Civil Code), or for any other liability that the law does not allow to be limited or excluded.

16. Changes to the Site and to these Terms

I may change the Site and update these Terms, for example when I add features or the law changes. The new version will be published on this page with a new date, and important changes will also be announced on the Site. Changes do not apply retroactively.

17. Governing law and disputes

These Terms are governed by Romanian law. If you live in another EU country, you keep the protection of the mandatory rules of the law of your country of residence.

Please write to me first at a direct message on Instagram; I would rather solve any problem directly. If we cannot agree, the competent Romanian courts have jurisdiction, without affecting any mandatory rights you have to go to the courts where you live.

18. General

If any part of these Terms is found invalid, the rest remains in force. If I do not enforce a right straight away, I do not give it up.

These Terms are written in English. Translations may be provided for convenience; where a translation differs, the English version applies, unless the law of your country requires otherwise.
